Court’s ruling with regard to preselection orders


WARSAW, Poland – November 5, 2004 – Netia SA (“Netia” or the “Company”) (WSE: NET), Poland's largest alternative provider of fixed-line telecommunications services, announced that it received today an interim injunction issued by the District Court in Warsaw (the “Court”), dated October 25, 2004, securing Netia’s claims against Telekomunikacja Polska SA (“TP”) with regard to unfair competition acts (the “Ruling”). In the Ruling, the Court ordered TP to refrain, until the Court’s final and binding decision, from delaying the execution of preselection orders placed by Netia’s clients by more than 14 days from the date of their receipt.
 
In the on-going proceedings, Netia demands from TP to seize the above mentioned acts of unfair competition and publish the appropriate official apologies in the media. In the Court’s opinion, Netia made the claims probable, which justified granting the interim injunction for the time of the proceedings.
