Court’s decision with regard to the motions of Millennium and its related parties for Netia’s bankruptcy


WARSAW, Poland – December 15, 2004 – Netia SA (“Netia”) (WSE: NET), Poland’s largest alternative provider of fixed-line telecommunications services, today announced that the District Court of the Capital City of Warsaw, XVII Commercial Division for bankruptcy and restructuring matters (the “Court”) resolved on December 14, 2004 with regard to the motions for the declaration of bankruptcy of Netia, filed by Millennium Communications SA (“Millennium”), Newman Finance Corporation (“NFC”), its sole shareholder, and Genesis sp. z o.o. (“Genesis”), its subsidiary.
 
The Court decided to dismiss the claims filed by Millennium and NFC and to discontinue the proceedings with regard to Genesis’ motion, following its withdrawal by Genesis. The ruling is not yet final and binding.
 
The Court’s ruling confirms the opinion of Netia’s management board expressed previously that the above motions for declaration of bankruptcy were totally groundless (see Netia’s press release dated August 10, 2004 and Netia’s financial statements for the period ended September 30, 2004).
