Dismissal of Newman’s claim against Netia


WARSAW, Poland – June 9, 2005 – Netia SA (“Netia”) (WSE: NET), Poland’s largest alternative provider of fixed-line telecommunications services, today announced that the District Court for the capital city of Warsaw, IV Civil Division (the “Court”) dismissed on June 8, 2005 the claim filed by Newman Finance Corporation (“NFC”), the sole shareholder of Millennium Communications SA (“Millennium”), for damages of PLN 45.4 million for alleged losses resulting from the seizure of Millennium shares by Netia.
 
The Court determined that NFC neither proved the damage occurrence nor its magnitude. The ruling is not yet final and binding.
