Court’s decision with regard to minority shareholders claims (1/2008)


WARSAW, Poland – January 2, 2008 – Netia SA (“Netia”) (WSE: NET), Poland’s largest alternative provider of fixed-line telecommunications services, today announced that it has received a copy of the judgement dated September 24, 2007 issued by the Regional Court in Warsaw, XVI Commercial Division, including confirmation that it is a final and valid judgement (Ref.: XVI GC 649/07). The Regional Court dismissed the claims of minority shareholders’ submitted for joint review and settlement, requesting the annulment of sections 10, 11 and 13 of Resolution No. 2 of the General Shareholders’ Meeting dated 4 April 2002, on the basis that the distribution of the Subscription Warrants issued by Netia within the scope of its financial restructuring was detrimental to the minority shareholders and in breach of good custom (see the current report dated August 2, 2002). The judgement is final and is not subject to appeal.
