The ruling of the Supreme Administrative Court in Warsaw regarding the determination of the amount of corporate income tax liability for 2003 (25/2013)


The management board of Netia SA (the “Company” or “Netia”), Poland’s largest alternative provider of fixed-line telecommunications services, announced today that, having reviewed the cassation appeal submitted by Netia S.A. against the judgment of the Regional Administrative Court in Warsaw dated 25 March 2011, in case No. III SA/Wa 1028/10 upholding the decision of the Director of the Tax Chamber in Warsaw regarding the determination of the amount of corporate income tax liability for 2003 as PLN 34,182,754 with interest accrued thereon (see current reports No. 42/2009 dated 17 August 2009, No. 4/2010 dated 17 February 2010 and No. 16/2011 dated 15 March 2011), the Supreme Administrative Court in Warsaw set aside the appealed judgment upholding the decision of the Director of the Tax Chamber in Warsaw in its entirety and remanded the case for reconsideration to the first-instance court. The ruling of the Supreme Administrative Court opens the way for a potentially favorable to Netia conclusion of the dispute. Currently, the Company is awaiting a written justification of the Supreme Administrative Court’s judgment.
